The deal, in plain words.

These Terms are a contract between you and Piffect (“we”, “us”), covering piffect.com and everything on it. By creating an account or using the service you accept them. If you do not accept them, do not use Piffect.

If you are agreeing on behalf of a company, you confirm you have authority to bind that company, and “you” means the company.

You must be at least 18 years old to use Piffect.

You describe a campaign. Piffect researches the market, drafts a posting calendar, writes the copy and generates the images and videos to run it, using third-party AI models.

The service is provided as it stands today. We add features, change them and occasionally remove them. If we remove something you depend on, or make a change that materially reduces what you are paying for, we will give you at least 30 days’ notice by email and you may cancel for a pro-rata refund of the unused part of your term.

Keep your password to yourself and keep your email address current, because it is how we reach you about security and billing. You are responsible for what happens under your account.

Tell us at info@pxlplay.app as soon as you suspect unauthorised access, and we will help you secure it.

• Generating things costs credits. New accounts get 250 credits free. Paid plans include a monthly allowance which is shown on the pricing page.
• Subscriptions renew automatically each month until you cancel. Cancel any time from your account; you keep access until the end of the period you have already paid for.
• Monthly credits do not roll over. Unused credits expire at the end of each billing period.
• If a generation fails on our side, we refund the credits. Credits are not refunded because you dislike the result. AI output is subjective, and a generation that ran is a generation we paid a provider for.
• Prices exclude tax unless stated. Where we are required to charge sales tax or VAT, it is added at checkout.
• We may change prices with 30 days’ notice by email. Increases never apply to a period you have already paid for.
• If a payment fails we may suspend generation until it clears. Your content stays intact while suspended.

Refunds. Beyond failed generations, we do not offer refunds for partial months. If something has genuinely gone wrong, email us. We would rather fix it than argue about it.

Your material stays yours

Briefs, brand kits, logos, product photos and anything else you upload remain entirely yours. We claim no ownership of them.

Output belongs to you

As between you and us, you own the campaigns, images, videos and copy Piffect generates for you, and you may use them commercially. Two honest caveats:

• AI output is not always protectable by copyright. The law on this is unsettled and varies by country, so we cannot promise you an enforceable copyright in a generated asset.
• Similar prompts can produce similar output for other users. We cannot promise your result is unique.

The licence you give us

To run the service we need a licence to host, store, transmit, reformat and display your content, and to send it to the AI providers who generate your campaign. That licence is limited to operating and improving Piffect for you, is non-exclusive, and ends when you delete the content or your account.

We will not use your content in our marketing without asking you first, and we do not train AI models on it. See the Privacy Policy.

Do not use Piffect to:

• Break the law, or infringe anyone’s copyright, trademark, privacy or publicity rights, including uploading brand assets you have no right to use.
• Generate sexual content involving minors, or any content that sexualises a real person without consent.
• Create deepfakes of real people, impersonate anyone, or produce deceptive political content.
• Produce harassment, hate speech, incitement to violence, or content designed to defraud.
• Resell raw model access, scrape the service, or run it as the backend of a competing product.
• Circumvent credit limits, share one account across an organisation to avoid paying for seats, or automate the service in a way that degrades it for others.
• Probe, reverse-engineer or attack the infrastructure.

You are responsible for the campaigns you publish. Advertising is regulated in most countries, and claims about products, health, finance and prices are your responsibility, not ours.

The Piffect name, wordmark, interface, design system, templates and underlying software are ours and stay ours. Your subscription buys the right to use the service, not to copy it. Feedback you send us we may use freely, without obligation to you.

Piffect runs on Google, fal.ai, Supabase, Cloudflare, Stripe and Resend. Their outages become our outages, and their content policies apply to what you generate. We choose these providers carefully but we do not control them, and we are not liable for their acts or omissions beyond our own reasonable care in selecting and managing them.

We aim to keep Piffect up but we do not promise an uptime figure, and there is no service level agreement on any plan. We may take the service down for maintenance, and will try to do it when it hurts least. AI providers impose rate limits and queues, so at busy times generation may be slower.

The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that generated output will be accurate, original, suitable for your purpose, or that the service will be uninterrupted or error-free. Always review what you publish.

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill, even if warned they were possible.

Our total liability arising out of or relating to these Terms is limited to the greater of the amount you paid us in the 12 months before the claim arose, or USD 100.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, in which case they simply do not apply to you.

You agree to cover our reasonable costs, including legal fees, if a third party brings a claim against us because of the content you uploaded or published, or because you broke these Terms or the law. We will tell you promptly about any such claim and let you control the defence, provided any settlement releases us fully.

You may cancel or delete your account at any time, for any reason. Deleting your account erases your content. See how long we keep things.

We may suspend or close an account that breaks these Terms, exposes us to legal risk, or does not pay. Except where the breach is serious or unlawful, we will warn you first and give you a chance to put it right. If we close your account without cause, we refund the unused portion of your term.

Before closing an account for cause we will, where we lawfully can, give you 30 days to export your work.

We may update these Terms. For material changes we will email you at least 30 days before they take effect, and continuing to use Piffect after that means you accept them. If you do not, cancel before the date and we will refund the unused part of your term.

These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws rules. Disputes go to the state and federal courts located in Indiana, and both of us consent to their jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live, or of the right to bring a claim in your local courts.

Before filing anything, please email info@pxlplay.app. Most disputes are a misunderstanding and we would rather resolve it directly.

• Whole agreement. These Terms and the Privacy Policy are the entire agreement between us on this subject.
• Severability. If a clause is unenforceable, the rest stands.
• No waiver. Not enforcing something once does not mean we give up the right to enforce it later.
• Assignment. You may not transfer this agreement without our consent. We may transfer it if the business is sold, on notice to you.
• Force majeure. Neither of us is liable for failures caused by events genuinely beyond our control.
• Survival. The sections on content ownership, warranties, liability, indemnity and governing law survive termination.
